On August 15, 2022, lawyer Manish Gupta visited the ‘Namak’ restaurant in Buxar to celebrate his birthday. He ordered a special masala dosa, which was priced at Rs 140. To his dismay, he discovered that the essential accompaniment, sambhar, was missing from his order. When Gupta inquired about the missing sambhar, the restaurant responded with an unsatisfactory remark, asking if he intended to purchase the entire establishment for Rs 140.

Unwilling to accept such negligence, Gupta took the matter to the District Consumer Commission and filed a complaint against the restaurant. The Division Bench of the Consumer Commission, after reviewing the case, found the Bihar restaurant guilty of negligence. As a result, the restaurant was ordered to pay a fine of Rs 3,500. The penalty consisted of Rs 1,500 as a basic fine and Rs 2,000 as litigation fees. The Consumer Commission recognized the mental, physical, and economic inconvenience caused to the litigant and deemed the penalty justified.

This incident raises questions about the quality of service and the responsibility of restaurants to fulfill customers’ expectations. While the verdict may seem harsh to some, it sends a message to establishments that consumer satisfaction is paramount. It emphasizes the significance of upholding food standards and meeting customer demands.
